Terms of Service
Last Revised: January 15, 2026 • Valid for All European Deployments
1. Scope and Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between Loopsterhorizn Mobility B.V. ("Loopsterhorizn", "we", "us", or "our") and any individual or commercial entity ("Customer", "You") accessing our websites, purchasing physical EV charging hardware, procuring turnkey engineering installations, or subscribing to the Loopster GridOS Cloud Management Platform.
By purchasing, installing, or interacting with our services, you expressly acknowledge and agree to comply with all terms herein.
2. Electrical Safety & Certified Installation Mandates
Electric Vehicle Supply Equipment (EVSE) operates at high voltages and continuous amperage. All Loopsterhorizn charging units (Titan 400 DC, DepotCore 120, Horizon Pure 22) must be installed, configured, commissioned, and serviced exclusively by qualified, licensed electrical contractors adhering to national electrical safety standards (e.g., NEN 1010, DIN VDE 0100-722, NFC 15-100, BS 7671). Attempting installation or unsealing internal high-voltage enclosures without certified technicians instantly voids all equipment warranties and indemnifies Loopsterhorizn from all resulting liability.
3. Cloud Software License & Uptime SLA
Subject to payment of active software subscription tiers, Loopsterhorizn grants the Customer a non-exclusive, non-transferable, revocable license to access Loopster GridOS for charge point remote telemetry, automated billing, load balancing, and fleet schedule orchestration.
- Target Uptime SLA: We target a minimum cloud platform availability of 99.8% per calendar month, excluding scheduled maintenance windows announced at least 48 hours in advance.
- OCPP & OCPI Protocols: We maintain strict conformance with open communication standards (OCPP 1.6-J, OCPP 2.0.1, OCPI 2.2). The Customer remains responsible for maintaining local internet connectivity (Ethernet, Wi-Fi, or cellular LTE coverage) at physical charge sites.
4. Pricing, Tariffs, and Energy Settlements
All prices quoted for hardware, subscriptions, and engineering works are exclusive of applicable Value Added Tax (VAT) unless explicitly specified. Dynamic spot-price electricity pass-throughs executed via Nord Pool or EPEX Spot connections are subject to grid utility transmission charges, taxes, and local Distribution System Operator (DSO) tariffs beyond Loopsterhorizn's direct control.
5. Intellectual Property Rights
All software source code, firmware algorithms, hardware industrial designs, registered trademarks, user interface designs, and technical documentation associated with Loopsterhorizn products are the exclusive intellectual property of Loopsterhorizn Mobility B.V. No reverse engineering, decompilation, or unauthorized reproduction of firmware or hardware schematics is permitted.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Loopsterhorizn Mobility B.V., its directors, employees, or subsidiaries be liable for any indirect, incidental, punitive, or consequential damages—including loss of grid power, lost revenue from third-party EV charging sessions, vehicle battery degradation caused by third-party vehicle BMS faults, or utility peak-demand surcharges resulting from external grid outages. Our aggregate cumulative liability shall not exceed the total amount paid by the Customer to Loopsterhorizn during the twelve (12) months preceding the claim event.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any legal dispute, controversy, or claim arising out of or in connection with this contract shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands.
